L’ACTA, UNE ARME D’INTIMIDATION POUR LES INDUSTRIES DU DIVERTISSEMENT

En appliquant une pression légale et financière sur les fournisseurs d’accès à Internet (d’une façon beaucoup plus subtile que dans les précédentes versions), l’ACTA donnera aux industries de la musique et du cinéma une arme obligeant les fournisseurs d’accès à faire la police de leurs réseaux et leurs utilisateurs. De telles polices et justices privées du Net sont incompatibles avec les impératifs démocratiques et représentent une menace pour les libertés fondamentales.

These procedures shall be implemented in a manner that avoids the creation of barriers to legitimate activity, including electronic commerce, and, consistent with each Party’s law, preserves fundamental principles such as freedom of expression, fair process, and privacy.: Cette référence totalement nouvelle (bien que non définitive) à l’encontre des « moyens massifs de distribution de contrefaçon » est très inquiétante. Elle pourrait être interprétée comme moyen de justifier la mise en place de mesures criminalisant indirectement les plateformes de blogs, les réseaux P2P, le logiciel libre, et d’autres technologies contribuant à la diffusion de la culture et de la connaissance sur Internet.

L’ACTA INSTAURE DES SANCTIONS PÉNALES ÉTENDUES ET DANGEREUSES

L’ACTA impose de nouvelles sanctions pénales, outrepassant les procédures démocratiques classiques de l’Union Européenne et des États Membres. La formulation est très vague, et de nombreuses pratiques non-lucratives pourraient se voir sanctionnées pénalement.

Article 2.14.49With respect to the offenses specified in this Section, each Party shall ensure that criminal liability for aiding and abetting is available under its law.: Sanctions criminelles pour « apport d’aide et complicité » avec une infraction. Il n’est pas aceptable que des sanctions criminelles fassent partie d’un « accord commercial ». Les mesures telles que celles-ci ne devraient être introduites qu’après un débat démocratique. Par ailleurs, la délineation entre « aide » et parole politique est floue.

Article 2.14.110Each Party shall provide for criminal procedures and penalties to be applied at least in cases of willful trademark counterfeiting or copyright or related rights piracy on a commercial scale.: L’ACTA implique des sanctions pénales en cas de violation « à échelle commerciale ». Ce terme est vague, sujet à interprêtation, et tout simplement inadapté lorsqu’il s’agit d’une approche propotionnée pour sanctionner les atteintes aux droits de « propriété intellectuelle ». Des pratiques sociales largement répandues telles que le partage (non-commercial) de fichiers entre individus pourraient être interprétées comme relevant d’une « échelle commerciale ». Le champ d’application de cet accord devrait être limité aux activités « à but commercial » ou « lucratives ».

ACTA PERMETTRA DE CONTOURNER DURABLEMENT LA DEMOCRATIE

Un « Comité ACTA » sera autorisé à modifier l’accord après sa ratification. Un tel processus legislatif parallèle, qui revient à signer un chèque en blanc à l’ACTA, est incompatible avec les procédures démocratiques traditionnelles. Cela justifie en soi que l’accord soit rejeté dans son ensemble.

Articles 5 et 6115. All decisions of the Committee shall be taken by consensus, except as the Committee may otherwise decide by consensus. The committee shall be deemed to have acted by consensus on a matter submitted for its consideration, if no Party present at the meeting when the decision is taken formally objects to the proposed decision. ). Ces articles préparent le terrain pour un contournement durable du processus démocratique, même après le vote de l’ACTA. Aucun représentant élu ne devrait tolérer ceci dans un régime démocratique, puisque cela reviendrait à ouvrir la porte à une généralisation de ce genre de pratique.
